1. Termini di servizio

1.1. I presenti Termini di servizio, insieme alla nostra Informativa sulla privacy, costituiscono l’intero accordo tra la nostra azienda Intercontinental Care OÜ (di seguito denominata “ICC”, “Intercontinental Care”, “Azienda”, “Noi”, “Ci”, “Nostro”) e tu come nostro cliente (di seguito denominato “Tu”, “Tuo”, “Utente”).
1.2. Il presente Contratto regola l’utilizzo del sito web della nostra azienda www.interconcare.com (il “Sito web”) e dei Servizi resi da Intercontinental Care (il “Servizio” o i “Servizi”).
1.3. Utilizzando il Sito Web e/o richiedendo i nostri Servizi, accetti i termini stabiliti nel presente Contratto e farai del tuo meglio per rispettare questi Termini. Nel caso in cui non siate d’accordo con il presente Accordo in tutto o in parte, siete pregati di interrompere immediatamente l’utilizzo del Sito Web e/o dei nostri Servizi.
1.4. Intercontinental Care si riserva il diritto di apportare modifiche ai termini del contratto con o senza preavviso all’utente. È tua esclusiva responsabilità verificare periodicamente eventuali modifiche o aggiornamenti al Contratto. Se non sei d’accordo con la nuova versione aggiornata del Contratto, interrompi l’utilizzo del Sito e/o dei nostri Servizi.
1.5. Per poter utilizzare il Sito e/o i Servizi è necessario avere almeno 18 anni. Se sei minorenne, smetti di utilizzare il Sito e/o i nostri Servizi e chiedi ai tuoi genitori o al tutore legale di richiedere i nostri Servizi per tuo conto.

2. Servizi

2.1. Intercontinental Care è una società di consulenza che fornisce agli Utenti del proprio sito Web informazioni sui servizi medici e sugli operatori sanitari in tutto il mondo. Utilizzando il Sito Web e/o i nostri Servizi ti verrà fornita una gamma di fornitori di servizi medici in base alla tua specifica richiesta, inclusi ma non limitati a ospedali, cliniche, centri medici, centri medici, centri di riabilitazione, ecc. (di seguito denominati come “Fornitori”).
2.2. ICC fornisce un elenco e una descrizione dei servizi dei Fornitori più idonei in base alle esigenze specifiche di ciascun Utente (es. lingua, paese, condizione medica, ecc.). L’Utente può quindi decidere se desidera fissare un appuntamento con uno di questi Fornitori o richiedere ulteriori informazioni.
2.3. Le informazioni relative ai Fornitori che sono disponibili sul Sito Web e sono state ricevute dai Fornitori stessi o sono state create sulla base delle informazioni dei siti Web dei Fornitori. Facciamo del nostro meglio per assicurarci che tali informazioni siano accurate e aggiornate. Tuttavia, Intercontinental Care non può garantire e non può essere ritenuta responsabile dell’accuratezza e della precisione di tali informazioni. Intercontinental Care non sarà responsabile per la mancata fornitura di informazioni accurate da parte di un Fornitore, né il Sito Web potrà essere considerato una rappresentazione, raccomandazione, garanzia o approvazione della qualità del servizio e della specializzazione di qualsiasi Fornitore.
2.4. Intercontinental Care non è un fornitore di servizi medici, ma un intermediario tra l’Utente e il Fornitore. Pertanto, qualsiasi informazione fornita sul Sito Web e/o attraverso il Servizio, incluse, ma non limitate a, le informazioni fornite dai Fornitori o da qualsiasi altra terza parte, non può essere considerata come una consulenza medica o una visita medica adeguata e non può essere utilizzata su spetta a lui decidere se procedere con un trattamento medico o interromperlo.
2.5. Alcuni prodotti farmaceutici visualizzati sul nostro sito necessitano della prescrizione del medico per il loro corretto utilizzo mentre altri potrebbero essere vietati in alcuni Paesi. È tua esclusiva responsabilità assicurarti di rispettare le raccomandazioni del tuo medico e le leggi del paese in cui vivi.

3. Pagamento

3.1. Gli utenti del nostro sito Web non devono pagare per i servizi di consulenza forniti da Intercontinental Care.
3.2. Il pagamento viene effettuato solo e direttamente al Fornitore scelto dall’Utente per i servizi che saranno o che sono già stati forniti dal Fornitore.
3.3. Intercontinental Care non vende né condivide le informazioni personali dei propri Utenti con terzi per scopi pubblicitari

4. Valutazioni mediche

4.1. Il nostro servizio comprende la valutazione delle condizioni passate e presenti dell’Utente, l’analisi della sua storia medica, la preparazione di piani di trattamento e preventivi da parte dei Fornitori, il follow-up e l’assistenza nel confronto di diverse offerte.
4.2. Per ottenere i migliori risultati, raccomandiamo che l’Utente riceva le cure primarie da un medico specialista locale prima di procedere all’utilizzo del Sito Web e dei Servizi di Intercontinental Care. Ciò garantisce che l’Utente abbia una migliore comprensione del tipo di trattamento di cui ha bisogno, nonché degli esami e delle immagini mediche necessari che verranno esaminati dai Fornitori.
4.3. Richiedendo un Servizio l’Utente concorda e accetta che:

- - La valutazione iniziale ricevuta sarà limitata e provvisoria;
  - La valutazione iniziale non è considerata né mira a sostituire una valutazione medica completa o una visita di persona da un medico;
  - Gli specialisti medici che forniscono servizi attraverso il sito Web non possiedono informazioni cruciali che di solito vengono raccolte durante un esame di persona;
  - L’assenza di un esame di persona può influire sulla capacità del medico specialista di diagnosticare la tua condizione, malattia o lesione.

4.4. L’Utente accetta che la valutazione medica effettuata da Intercontinental Care non verrà utilizzata in alcun tipo di procedimento legale inclusi, ma non limitati a, controversie legali, contenziosi, arbitrati, richieste di prestazioni di invalidità ecc.

4.5. L’Utente può fornire cartelle cliniche per conto di un’altra persona, ma solo se l’Utente fornisce preventiva notifica a Intercontinental Care che:

- - La persona è un familiare dell’Utente;
  - L’Utente ha ricevuto il consenso preventivo di quella persona per rappresentarlo;
  - La persona non è in grado di inviare da sola una richiesta tramite il sito web.

4.6. Per ricevere qualsiasi tipo di Servizio da Intercontinental Care, l’Utente dovrà fornire identificazione, contatto e qualsiasi altra informazione rilevante richiesta per verificare l’identità dell’Utente. È responsabilità esclusiva dell’Utente mantenere l’accuratezza e la completezza di queste informazioni. Fornendo tali informazioni l’Utente garantisce che le informazioni siano vere e accurate.
4.7. Intercontinental Care raccoglierà la documentazione medica completa necessaria e successivamente creerà un caso medico. In conformità alle informazioni fornite, Intercontinental Care abbinerà il caso medico dell’Utente a un massimo di 3 (tre) diversi specialisti medici nella rete di Fornitori di Intercontinental Care o al di fuori di essa se la complessità del caso lo richiede. Questi specialisti medici riceveranno la documentazione da Intercontinental Care e creeranno un piano di trattamento. I Fornitori invieranno quindi i piani di trattamento e i preventivi dei prezzi a Intercontinental Care che li inoltrerà all’Utente. L’Utente avrà il diritto di scegliere quale specialista medico e fornitore fornirà il trattamento.

5. Limitazione di responsabilità

5.1. Ad eccezione di quanto espressamente stabilito nei presenti termini o nei termini aggiuntivi, Intercontinental Care non fa alcuna promessa o dichiarazione di qualità sui servizi da essa resi e non fornisce alcuna garanzia riguardo a tali servizi.
5.2. Utilizzando il Sito Web e i suoi Servizi confermi esplicitamente di comprendere, assumerti la responsabilità e assumerti tutti i rischi, diretti o indiretti, derivanti dall’utilizzo del Sito Web senza limitazioni.
5.3. Intercontinental Care e i suoi dipendenti, dirigenti, partner, azionisti e agenti non si assumono alcuna responsabilità per guasti di qualsiasi tipo o chiusura del sito Web con conseguente perdita di informazioni commerciali, profitti o altre perdite finanziarie dovute a reclami di qualsiasi tipo, perdite, istanze, azioni o altri eventi che si verificano a causa della validità delle presenti condizioni d’uso, inclusi senza limitazioni la navigazione del sito, l’uso, l’accesso a qualsiasi file o parti di esso.
5.4. Intercontinental Care non si assume alcuna responsabilità per la correttezza, il completamento e l’aggiornamento delle informazioni fornite dai Fornitori e/o da qualsiasi altra terza parte sul Sito web.

Intercontinental Care non si assume alcuna responsabilità in caso di danni o perdite, diretti o indiretti, dovuti a visite provenienti da Intercontinental Care o all’utilizzo di servizi da siti Web di terzi.
5.6. Inoltre, accettando i termini del presente accordo, l’Utente si impegna a indennizzare, difendere e tenere indenne Intercontinental Care, le sue affiliate e i rispettivi direttori, funzionari, dipendenti, azionisti, partner e agenti (collettivamente, le “Parti Intercontinental Care”) da e contro tutti i reclami, responsabilità, perdite, danni, costi e spese (incluse ragionevoli spese legali) sostenuti da qualsiasi parte di Intercontinental Care a seguito di, o in connessione con, qualsiasi violazione o presunta violazione da parte dell’Utente o di chiunque agisca per conto dell’Utente per conto di uno qualsiasi dei termini del presente Contratto.

6. Protezione dei dati

6.1. Per ricevere la funzionalità completa del sito Web e ottenere l’accesso a tutte le funzionalità del sito Web, è necessario fornire alcune informazioni private incluse, ma non limitate a, informazioni personali, specifiche e sensibili.

In nessun caso Intercontinental Care sarà responsabile per qualsiasi inadempimento o ritardo nell’adempimento dei suoi obblighi derivanti da o causati da, direttamente o indirettamente, forze al di fuori del suo controllo, inclusi, senza limitazione, scioperi, interruzioni del lavoro, incidenti, atti di guerra o terrorismo, disordini civili o militari, catastrofi nucleari o naturali o cause di forza maggiore e interruzioni, perdite o malfunzionamenti di utenze, comunicazioni o servizi informatici (software e hardware).

11. Legge applicabile

11.1. La validità, l’interpretazione e l’applicazione delle presenti Condizioni d’uso, le questioni derivanti da o correlate all’esecuzione o alla violazione delle presenti Condizioni d’uso e le questioni correlate saranno regolate dalle leggi dell’Estonia .

11.2. Qualsiasi azione o procedimento legale riguardante la validità, l’interpretazione e l’applicazione delle presenti Condizioni d’uso, le questioni derivanti da e/o correlate all’esecuzione o alla violazione delle presenti Condizioni d’uso e le questioni correlate saranno risolte mediante negoziazioni.

11.3. Nel caso in cui sia impossibile raggiungere una soluzione comune attraverso i negoziati, tutte le controversie saranno portate esclusivamente nei tribunali situati in Estonia . Tutte le parti acconsentono alla giurisdizione esclusiva di tali tribunali, rinunciando a qualsiasi obiezione alla proprietà o alla convenienza di tali sedi.

12. Separabilità

12.1. Qualsiasi disposizione dei presenti Termini di servizio che sia vietata o inapplicabile in qualsiasi giurisdizione sarà, in tale giurisdizione, inefficace nella misura di tale divieto senza invalidare le restanti disposizioni del presente documento, e qualsiasi divieto di questo tipo in una particolare giurisdizione non invaliderà o renderà inapplicabile tale disposizione in qualsiasi altra giurisdizione.

13. Assegnazione

L’Utente non può cedere o trasferire alcuno dei diritti o degli obblighi dell’Utente ai sensi dei presenti Termini di servizio senza il previo consenso scritto della Società. Intercontinental Care può cedere o trasferire alcuni o tutti i diritti della società ai sensi dei presenti Termini di servizio, in tutto o in parte, senza ottenere il previo consenso o l’approvazione dell’Utente.

14. Rinuncia

14.1. Il mancato o ritardato esercizio da parte di Intercontinental Care di qualsiasi diritto, potere o privilegio ai sensi dei presenti Termini non costituirà una rinuncia agli stessi.

15. Intestazioni

15.1. I titoli delle disposizioni sono solo per comodità e non devono essere utilizzati per limitare o interpretare alcuna disposizione delle presenti Condizioni.

16. Traduzioni

16.1. La versione originale e giuridicamente vincolante di questo documento è scritta in inglese ed è tradotta in altre lingue per comodità degli utenti non anglofoni. In caso di discrepanze tra la versione inglese e la versione tradotta, sarà considerata valida la versione inglese anziché quella tradotta.

These Terms of Service together with Our Privacy Policy form the entire Agreement between Intercontinental Care OU (hereinafter referred to as “ICC”, “Intercontinental Care”, “Company”, “We”, “Us”, “Our”) and You as an individual (hereinafter referred to as “You”, “Your”, “User”, “Client”, “Patient”).
This website is funded by private company Intercontinental Care OU.
This Agreement governs the use of Company’s Website www.interconcare.com (the “Website”) and Services rendered by Intercontinental Care OU (the “Service”, “Services”).
By using the Website and/or the Services You hereby warrant that You agree with the terms set out in this Agreement and You will apply best efforts in order to comply with these Terms. In the event You disagree with this Agreement in full or any portion of it, please immediately stop using the Website and/or the Services.
Intercontinental Care reserves the right to, from time-to-time, introduce changes to the terms of the Agreement with or without prior notification to You as a User. It is Your sole responsibility to periodically check for any changes or updates to this Agreement. If You do not agree with the new updated version of the Agreement please stop using the Website and/or the Service.
In order to use the Website and/or the Service You must be of legal age to do so and to be eligible to operate such Website or Service according to the applicable legislation. If You are not of legal age please stop using the Website and/or the Service. We reserve the right to terminate the Agreement between Intercontinental Care and an individual of under legal age at Our sole discretion and without notice to the individual.

Service

Intercontinental Care is a medical tourism company that provides information about medical services and their providers to the User. By using the Website and/or the Service You, as a User, are provided with a range of medical service providers, including but not limited to hospitals and clinics (“Medical Providers”).
Intercontinental Care does not assign a Patient with a specific Medical Provider, it simply provides a list consisting of most suitable Medical Providers based on specific needs of a Patient (e.g. language, country, medical status etc.). According to the list, a Patient is entitled to choose which Medical Provider to make an appointment with.
The information, regarding the Medical Providers, that is available on the Website is gathered either from the Medical Providers themselves or by manually gathering such information from their websites. We do Our best to make sure that such information is accurate and up-to-date. However, Intercontinental Care cannot guarantee and cannot be held responsible for the accuracy and preciseness of such information. Intercontinental Care will not be liable for failure to provide accurate information from a Medical Provider, nor shall the Website be regarded as a representation, recommendation or endorsement of the service quality and the specialization of the Medical Providers.
Intercontinental Care is not a medical service provider, but an intermediary between the User and the Medical Provider. Therefore, any information provided on the Website and/or through the Service including, but not limited to, the information provided by the Medical Providers and any other third-parties cannot be viewed as a proper medical consultation or medical examination and cannot be used to on one’s own to decide whether to proceed to the medical treatment or to terminate it.
Some pharmaceutical products displayed on our website may be forbidden in certain jurisdictions, please be cautious when choosing your type of medication, it is your sole responsibility to make sure that you comply with the law of the country you are resident and/or citizen of.

Payment

Users do not pay for Intercontinental Care’s Services.
The payment for services is done directly the Provider chosen by the User.

Medical Assessments

The Service includes an evaluation of User’s past and present condition(s), analysis of medical history, diagnosis and treatment plan conducted by doctors of Medical Providers. Provision of this service may depend on User’s condition. In order to be able to utilize the service, User should get a primary care from a local medical specialist prior to proceeding to the use of the Intercontinental Care’s Website.
By requesting a Service the User agrees and accept that:
The initial assessment received will be limited and provisional;
The initial assessment is not considered nor aimed to replace a full medical evaluation or an in-person visit to a physician;
The medical specialists who are providing services through the Website and its portals do not possess crucial information which is usually gathered through an in-person examination;
The absence of an in-person examination may affect the medical specialist’s ability to diagnose Your condition, disease or injury.
Furthermore, the User agrees that Intercontinental Care reserves a right to review at any time the User’s medical records from before and after Your interaction with the Website and its portals, and any records created as a result of received services. Intercontinental Care may request additional medical records including, but not limited to, records related to care the User received after obtaining the services. Requested records may be reviewed by Intercontinental Care in order to get better a understanding of the course of treatment for User ’s condition(s) including information related to outcomes and costs, also such reviewing may be used to improve treatments and recommendations. Moreover, the User agrees that in case that Intercontinental Care does not have the right specialist in the Provider’s network, Intercontinental Care may contact third-parties outside of Intercontinental Care’s network.
Furthermore, by requesting any services through the Website or its portals, the User provides Intercontinental Care with the authority to collect, store User’s medical records and/or to transfer them to the designated physician(s) appropriate for the User’s case. Also, the User agrees that the medical assessment will not be used in any kind of legal proceedings including, but not limited to, legal disputes, litigation, arbitration, claim for disability benefits etc.
The User has a right to provide medical records on behalf of a third-party, but only if User provides prior notification to Intercontinental Care that:
The third-party is a User’s family member;
The User received a prior consent from the third-party to represent him/her;
The third-party is not able to send a request via Website or its portals by him/herself.
In order to receive any kind of services from Intercontinental Care, the User shall provide current and accurate identification, contact and any other relevant information required to verify User’s identity and eligibility. It is within User’s sole responsibility to maintain the accuracy and completeness of this information. By providing such information User states that the information is true and accurate.
Intercontinental Care will collect the complete medical records needed and afterward will create a Medical Case. In accordance to the information provided, Intercontinental Care will match User’s medical case with up to 3 (three) different Medical Specialists in Intercontinental Care’s network of Providers or outside of it, medical specialist will be picked according to the specialty which User’s diagnosis falls under. These Medical Specialists will receive the documentation from Intercontinental Care and create a treatment plan. The Providers will then send the treatment plans and price quotations to Intercontinental Care. The User which will have the right to choose which Medical Specialist and Provider will provide the treatment.

Limitation of Liability

Other than as expressly set out in these terms or additional terms, Intercontinental Care does not make any promises or quality declaration about the services rendered by it and does not provide any guarantees regarding those services.
By using the website its portals and services you explicitly confirm that you understand and take responsibility and assume all risks, direct or indirect, resulting from the use of the website without limitations.
Intercontinental Care and its employees, management, partners, shareholders, and agents do not bear any responsibility for failures of any kind or shutdown of the website resulting in loss of business information, profit or other financial losses due to claims of any kind, losses, petitions, actions or other events occurring due to validity of these terms of use, including without limitations the website navigation, use, access to any files or their parts. Also, any rights including even in the event Intercontinental Care was advised of the theoretical possibility of such damages, irrespective of whether the occurring event and damage were the result of infringement on intellectual or any other property, based on a breach of law, negligence, contract liabilities or other similar cases and situations, or not.
Intercontinental Care bears no liability for the correctness, completion and up-to-dateness of any information provided by Providers and/or any other third-parties on the website.
There may be links to third-party websites on this website. Such links are provided solely for the convenience of the user. Intercontinental Care shall not bear any liability in case of any damages or losses, direct or indirect, due to a visitation originating from Intercontinental Care, or to the use of services from third-party websites.
Moreover, consenting to the terms of this agreement, the user agrees to indemnify, defend and hold Intercontinental Care, its affiliates and their respective directors, officers, employees, shareholders, partners and agents (collectively, the “Intercontinental Care Parties”) harmless from and against all claims, liability, losses, damages, costs and expenses (including reasonable legal fees) incurred by any Intercontinental Care party as a result of, or in connection with, any breach or alleged breach by the user or anyone acting on the user’s behalf of any of the terms of this agreement.

Data Protection

In order to receive complete Website functionality and get access to all of the Website’s features, You are required to provide certain private information including, but not limited to, personal, specific and sensitive information.
We respect the confidentiality of private and personal information of all cooperating parties. However, there is no perfect secure method of protecting information during its storage, processing, and transfer into electronic form. We do not give the full warranty of its complete safety, despite all efforts made by the Intercontinental Care.

Website and its materials are protected by legal and subordinate acts relating to intellectual property including but not limited to copyright laws and other similar laws.

Unconditioned use and reproduction of the materials presented at the Website without the written permission of Intercontinental Care is prohibited.
